Tak zwany syndrom pierwszej dniówki ma zlikwidować projekt ustawy nowelizującej kodeks pracy przyjęty przez rząd. Umowa z pracownikiem będzie musiała być podpisana przed dopuszczeniem go do pracy, a nie jak dotychczas do końca pierwszego dnia jej wykonywania.
Nowa regulacja ma ograniczyć zatrudnianie pracowników w szarej strefie. Pracodawca nie będzie mógł już powiedzieć inspektorom pracy, że pracownicy nie mają jeszcze pisemnych umów, ponieważ jest to ich pierwszy dzień w pracy. Ze sprawozdania Państwowej Inspekcji Pracy wynika, że nielegalne zatrudnienie w 2015 roku stwierdzono w 18 proc. kontrolowanych podmiotów, w 2013 roku było to 18 procent, a w 2012 roku 16 procent. Nielegalnie najczęściej zatrudniano w transporcie, gospodarce magazynowej, usługach gastronomicznych i związanych z zakwaterowaniem.
