UPC bezprawnie informowało konsumentów o podwyższeniu abonamentu za Internet – zdecydował UOKiK. Spółka musi oddać konsumentom nienależnie pobrane opłaty.
– Umowy, które zawieramy z dostawcami różnych usług na czas nieokreślony mogą się zmienić tylko wtedy, gdy w kontrakcie znajdują się tzw. klauzule modyfikacyjne – wyjaśnia szef UOKiK.
Postępowanie w tej sprawie wszczęto na początku ubiegłego roku na podstawie doniesień medialnych i skarg konsumentów. Wątpliwości Urzędu wzbudził sposób podwyższenia ceny za dostęp do Internetu o 7 zł miesięcznie w abonamencie, który zaczął obowiązywać od grudnia 2014 roku. Aby wyeliminować skutki niekorzystnej praktyki, UOKiK skorzystał z tzw. rekompensaty publicznej. Gdy decyzja będzie prawomocna, abonenci otrzymają zwrot za każdy opłacony miesiąc aż do czerwca 2016 roku. Na UPC nałożono także karę finansową 817 tys. zł za naruszenie zbiorowych interesów konsumentów. Decyzja nie jest ostateczna, przysługuje od niej odwołanie do Sądu Ochrony Konkurencji i Konsumentów.
