Pozytywna Szkoła w Kokoszkach powołana z naruszeniem prawa
Pozytywna Szkoła Podstawowa w Gdańsku – Kokoszkach została powołana z naruszeniem prawa – orzekł Wojewódzki Sąd Administracyjny.
To bezpłatna, publiczna szkoła prowadzona na zlecenie miasta Gdańska przez Fundację Pozytywne Inicjatywy z Pucka. Funkcjonuje drugi rok, zatrudnia prawie 80-u nauczycieli, a uczęszcza tam niemal tysiąc uczniów. Wczorajszy wyrok to wyniki powtórnego rozpatrzenia skargi NSZZ „Solidarność” dotyczącej przekroczenia uprawnień przez prezydenta Gdańska i oddania szkoły publicznej w ręce prywatne. Wojewódzki Sąd Administracyjny zajął się ponownie oddaloną wcześniej skargą na polecenie Naczelnego Sądu Administracyjnego. Orzekł, że szkoła w Gdańsku – Kokoszkach działa nielegalnie. Zwrócił uwagę na naruszenie przepisów dotyczących wynajmu lokalu, ponieważ budynek szkolny wraz z obiektami sportowymi nie jest lokalem lecz nieruchomością, co podnosiła Komisja Międzyzakładowa Pracowników Oświaty i Wychowania NSZZ „Solidarność” w Gdańsku jako strona skarżąca.
Naruszono również ustawę o związkach zawodowych – projekt zarządzenia Prezydenta Miasta Gdańska o przekazaniu do wynajmu nowo wybudowanego budynku szkolnego nie został przesłany związkom zawodowym do zaopiniowania. Wyrok nie jest prawomocny i każdej ze stron przysługuje prawo wniesienia skargi kasacyjnej do Naczelnego Sądu Administracyjnego.
