Pozytywna Szkoła w Kokoszkach działa zgodnie z prawem – oceniają władze Gdańska pomimo prawomocnego już wyroku Wojewódzkiego Sądu Administracyjnego w Gdańsku, który stwierdził że placówkę powołano z naruszeniem prawa. Sekcja oświaty NSZZ Solidarność już zapowiada kolejne kroki prawne.
Szkoła w Kokoszkach funkcjonuje jak szkoła publiczna, za naukę nie płaci się tu ani złotówki. Nie jest jednak prowadzona przez samorząd, więc nie obowiązuje w niej Karta Nauczyciela. Precedensowemu w skali kraju rozwiązaniu od dwóch lat sprzeciwia się Solidarność, pozew przez nią złożony dotyczył umowy cywilnoprawnej zawartej miedzy samorządem, a Fundacją Pozytywne Inicjatywy – tłumaczy zastępca prezydenta Gdańska ds. polityki społecznej Piotr Kowalczuk. W wyroku sądu, który właśnie się uprawomocnił, stwierdzono że umowa została zawarta z naruszeniem prawa. Nie wywołuje jednak skutku na przeszłość, ale na przyszłość – Szkoła w Kokoszkach w ramach tej umowy będzie funkcjonować aż do wygaśnięcia w 2020 roku. Bożena Brauer z Solidarności w Gdańsku zapowiada kolejne kroki w tej sprawie.
Komisja Międzyzakładowa Pracowników Oświaty i Wychowania NSZZ Solidarność w Gdańsku wezwała prezydenta miasta m.in. do cofnięcia pozwolenia na prowadzenie szkoły w Kokoszkach puckiej fundacji „Pozytywne Inicjatywy”.
