Jak podkreślono w uzasadnieniu ustawy, osoby uprawiające sporty wodne, będące pod wpływem alkoholu czy innych środków działających podobnie jak alkohol stwarzają poważne niebezpieczeństwo. Według policyjnych statystyk, w ubiegłym roku w całym kraju utonęło aż 646 osób. 157 z nich było w stanie nietrzeźwości.
