Nie można uzależniać przyjęcia reklamacji od paragonu
Sprzedawca nie może uzależniać przyjęcia reklamacji od dostarczenia paragonu fiskalnego – przypomina UOKiK w decyzji wydanej w sprawie Auchan Polska.
Postępowanie przeciwko spółce wszczęto w marcu, powodem było umieszczanie na paragonach informacji – cytuję – „Paragon jest niezbędny do reklamacji”. W ocenie Urzędu Ochrony Konkurencji i Konsumentów Auchan mógł wprowadzać konsumentów w błąd. Zgodnie z prawem podstawą złożenia reklamacji jest wada zakupionego towaru lub usługi, a paragon jest jednym z wielu możliwych dowodów nabycia rzeczy w danym sklepie i w danej cenie.
W toku postępowania Auchan zaniechał stosowania praktyki, a UOKiK przyjął zobowiązanie spółki że przez dwa lata będzie zamieszczać na paragonach informację iż „Paragon może ułatwić złożenie reklamacji, ale nie jest niezbędny do jej złożenia”. Podobne informacje znajdą się również na stronie internetowej spółki, w ogólnopolskich gazetkach ofertowych, na ladzie w Punktach Obsługi Klienta oraz serwisowo-gwarancyjnych we wszystkich sklepach stacjonarnych.
